Trademarking your logo

Your logo is the face of your business. It is an important piece of your brand identity and you'll want to make sure that you design it well and have the exclusive right to use it.

If you are at the start of your business journey and do not have the time or budget to design a unique logo, Canva could be your go-to option. There is nothing wrong with using Canva, but your rights to the logo created with Canva logo templates are non-exclusive and you cannot register it as a trademark.

A trademark is a sign that you can use to distinguish your products or services from those of other traders. It is highly beneficial for a business owner as it can give you protection and add value to your business.

Trademarking your brand will protect your brand by deterring others from using it. You can even license it to third parties or sell it for a sum if you decide to. Basically, registering your logo as a trademark takes your business one step further. In Singapore, you can register your brand as a trademark with the Intellectual Property Office of Singapore (IPOS) and once a trademark is registered, you'll enjoy the protection for 10 years from the date of filing.

It is also important to note that registering your business with Accounting and Corporate Regulatory Authority (ACRA) in Singapore does not equate to trademark protection. If you are going to use your brand name on your products and sell them in the market, you will need to it as a trademark with IPOS, in order to obtain exclusive rights to use the brand in the course of trade.

Now you know all the benefits and hope you are convinced to consider trademarking your brand, but the big question is what can you register as a trademark?

There are various ways to register your brand as a trademark. You can register your logo (primary or secondary), brandmark, primary brand color, or even an aspect of your packaging like an iconic bottle for your product, as long as you have the exclusive rights for your brand.

So, if you have a great vision for your business and plan to trademark your brand, I would highly recommend you consider working with a brand designer and get your branding right from the start. You may feel like you’re saving time now if you just start with a quick logo, but not being intentional with your brand from the start may cause you more headaches in the long run.
